TERMS AND CONDITIONS OF USAGE
(1) INTRODUCTION
This webportal is owned and operated by iROJGAR. We do not mean to substitute any policy and / or service of Government. These are the Terms of Use ('TOU') under which you may use www.irojgar.com (the 'Portal'). By using the Portal and the available services, you indicate your agreement to these TOU, including Privacy Statement. Please read these pages carefully. If you do not accept the TOU stated here, do not use the Portal. Since the TOU may change over time and without any advance notification you should also occasionally visit this page to review any modifications to the TOU because they are binding on you.
(2) LIMITATION OF LIABILITY OF iROJGAR
iROJGAR's web portal provide an online/offline job and vacancy information , intended to act as a virtual as well as a real market place for 'job seekers' and 'job providers' through the web. iROJGAR has no obligation to screen or censor any of the portals' content, nor iROJGAR is responsible for the actual direct transaction between employers and job seekers. Thus, iROJGAR has no control over the quality or legality of the jobs, or job seeker's qualifications, posted on this portal. iROJGAR makes no representations about the truthfulness of any jobs posted, job seeker's information or user content on the portal, and encourages all employers to conduct their own investigation as to a job seeker's suitability for employment and trustworthiness before engaging him/her for job.
iROJGAR's portal may contain inaccuracies or typographical errors. iROJGAR makes no representations/ claim about the accuracy, or completeness of portal or its content. iROJGAR is not to be considered an employer and shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on portal. iROJGAR cannot guarantee that any job seeker will exactly match what any employer wants, or that the job seeker will perform as required. No advice or information obtained by a user from the portals shall create any warranty whatsoever.
Please note that there are risks, including but not limited to, the risk of physical harm, of dealing with strangers, underage persons or people who misrepresent themselves online. When you use our portal and services, you assume all risks associated in dealing with other users with whom you come in contact through our portal. It is very much possible that other people's information may be offensive, harmful, inaccurate, or untrue. Please be careful while using this and other online, portals.
User authentication on the Internet is impossible and therefore iROJGAR does not warrant that each user is who they claim to be. Since iROJGAR is not, and cannot be involved in user-to-user dealings or control the behaviour of the participants on this/any portal, in the event that you have a dispute with one or more users, you release/keep aside iROJGAR (and our agents and employees) from claims and damages (whether actual and consequential, direct and indirect) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.
You acknowledge and agree that you are solely responsible for the form, content and accuracy of any material placed by you, or your mentor/representative, on the portal, and that you are 18 years of age or above. You also represent and warrant to iROJGAR that you will use the portals in a manner consistent with any and all applicable laws and regulations. iROJGAR in no way either represents or guarantees the accuracy, reliability or the truthfulness of any content uploaded by user. You hereby acknowledge that any dependence placed upon the posts made by other users is done entirely at your own risk.
(3) PERMITTED USES OF OUR PORTALS
The web portal does not constitute or purport to constitute a source of advice or a means to establish a business relationship of any kind between you and us. You acknowledge and voluntarily as well as expressly accept that your use of the web portal is made under your sole and exclusive responsibility. You have the following rights to the Portal (s): to post job openings and search job availability. All contents are the property of iROJGAR, and all contents are protected by applicable trademark/copyright laws or as per cyber guideline of government of India. You are not allowed to sell or modify the portal’s contents for any public or commercial use. In case of any violation, iROJGAR shall have the right to take any action permitted under law. iROJGAR can deactivate/delete your login access in such a situation. You are entitled to use portal on free or paid basis under certain condition prevailing at point of time as job seeker or as a job provider. Paid services of iROJGAR shows more result. The use of the portal’s contents on any other web portal or in a networked computer environment for any purpose is also expressly prohibited.
(4) PROHIBITED USES OF OUR PORTAL
Users are warranted to utilise only the portal in accordance with these Terms of Use and any relevant statutory provisions. Users are prohibited from violating the security of portal or its pages, by engaging in the following: (a) accessing data not intended for such user or logging into an account which the user is not authorized to access; (b) attempting to test the vulnerability of a system or to breach any security or authentication measures; or c) attempting to overload, spam, or crash this portal, by means of a 'virus' or any other software 'attack' upon the portal’s integrity. Any attempted portal violations may result in civil or criminal liability, and iROJGAR will prosecute users who are involved in such violations.
Users may not use this portal in order to transmit, or store material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy, publicity or other personal rights of others, (c) that is defamatory, obscene, threatening, abusive or hateful, or (d) in a manner which jeopardizes India's national security, contributes to social unrest, or sectarian violence.
All users agree not to engage in any activity which seeks to take advantage of or exploit other users of the portal or of the portal themselves. This prohibited behaviour includes, but is not limited to, the following: (a) offering business or sales opportunities; (b) offering jobs from competitors of the Firm, (c) posting any inaccurate or misleading content on the portals; (d) sending any unsolicited offer to portal users; (e) deleting any content or posting of other users; (f) engaging in any behaviour which has the effect of degrading the performance of the Portals.
User can utilise a space created for such purpose either on paid/ free basis after communication/permission from iROJGAR. Such space is advertisement window at home page. Event page is created for this purpose. These services may be paid/free. Decision for posting such matter shall be taken by iROJGAR.
(5) PROHIBITED CONTENT ON OUR PORTALS - HOW TO REPORT ABUSE
Any content which is offensive, dangerous, invades the privacy of others, or is unlawful is prohibited from the portals: This includes, but is not limited to, the following: (a) pornography,; (b) solicitation of illegal activities; (c) racial, religious, or ethnic slurs (d) incitement to violence against any individual for whatever reason; (e) the sending of junk mail or spam; (f) violating or advocating the violation of copyrighted works; (g) releasing private information of another users without their consent; and (h) providing information or instruction about illegal activities. Please report any abuse of our portal to support@irojgar.com. iROJGAR will take immediate necessary action.
(6) COLLECTION AND USE OF INFORMATION BY iROJGAR
In some areas of registration & profile creation, iROJGAR requests or may request that you provide personal information, including your name, address, e-mail address, telephone number, credit card number, contact information, billing information and any other information from which your identity is discernible. In other areas, iROJGAR collects or may collect demographic information that is not unique to you such as your religion, caste, age, preferences, gender, interests and favourites. Sometimes iROJGAR collects or may collect a combination of the two types of information.
iROJGAR also gathers or may gather certain information about your use of the portal, such as what areas you visit and what services you access. Moreover, there is information about your computer hardware and software that is or may be collected by iROJGAR. This information can include without limitation your IP address, browser type, domain names, access times and referring web portal addresses, but is not linked to your personal information.
In addition, at the time of registration for an account, you have the option to elect or not elect to receive additional communications, information and promotions, including without limitation, free informational newsletters from us relating to topics that may be of special interest to you, such as career management advice (I.e. Jobs in government sector, study or settlement abroad, etc.).
iROJGAR has areas on the portal where you can submit feedback. Any feedback you submit in these areas becomes our property, and iROJGAR can use such feedback for marketing purposes or to contact you for further information or business/professional services.
(7) CHOICES REGARDING THE DISCLOSURE OF PERSONAL INFORMATION TO OTHERS.
iROJGAR discloses information to third parties if you consent to portal’s terms and conditions of use. iROJGAR uses data about you (such as the interests and preferences you have expressed) to determine whether you might be interested in the opportunities, products or services of a particular third-party.
iROJGAR discloses information if legally required to do so, if requested to do so by a governmental entity or if iROJGAR believes in good faith that such action is necessary to: (a) confirm to legal requirements or comply with legal process; (b) protect our rights or property or our affiliated companies; (c) prevent a crime or protect national security; or (d) protect the personal safety of users or the public.
(8) OWNERSHIP AND RIGHTS TO USE MATERIALS
You are always welcome to provide iROJGAR with your opinion as to the quality of iROJGAR services, highlight the areas that need improvement in your opinion. However, please do not send us any creative ideas, suggestions or other materials that may generate scope of further money earning. It is our stated policy that iROJGAR will not accept or consider creative ideas provided by our users for compensating monetarily on these ideas. If you do provide iROJGAR with such materials or ideas, please be advised/note that all such ideas will become the property of iROJGAR, and iROJGAR will incur no obligation to you, and can use all such ideas without any compensation.
(9) INTELLECTUAL PROPERTY RIGHTS
All Intellectual property rights are vested solely with www.irojgar.com. No part of the webpage / service shall be reproduced or transmitted or stored in any other web portal, nor may any of its information or part thereof be disseminated in any electronic or non-electronic form, nor included in any public or private electronic retrieval system or service without obtaining prior written permission from www.irojgar.com. Any infringement in this regard shall be adequately compensated by such user if identified.
(10) VIOLATION OF TERMS OF USE AND THREATENING BEHAVIOUR.
Although not responsible for screening or monitoring user content, iROJGAR may review, deactivate and delete any content that violates these Terms of Use, violates applicable law, rule or regulation, is offensive or illegal, violates the copyrights of another, or violates the rights of, harms or threatens the safety of users of iROJGAR's Portal. If you engage in prohibited behaviour you risk expulsion from the portals, and future restrictions may be placed upon your continued access to the portals. If appropriate, legal action may be instituted against you. iROJGAR will also remove your content from the portals.
(11) INDEMNITY
Users agree to indemnify and hold www.irojgar.com and its subsidiaries, affiliates, officers, agents, co-branders or other partners and employees, harmless from any claim or demand, including reasonable attorneys’ fees made by any third party due to the content you submit, post or transmit through the service, your use of the service, your connection to the service, your violation of the Terms and Conditions, or your violation of any rights of another user and any third party claims.
(12) LIMITATION OF LIABILITY – REPUTATION OR MONETARY
You acknowledge and warrant that iROJGAR has not instigated and / or forced you to deposit money in iROJGAR's account in return of job guarantee or assured placement. In no event shall iROJGAR, its affiliates, its supplier's, or any third parties mentioned on any of iROJGAR's portal be liable for any kind of damages whatsoever (including, without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption or damage to reputation) resulting from the use or inability to use any of iROJGAR's portals and content, whether based on warranty, contract, tort, or any other legal theory, and whether or not iROJGAR is advised of the possibility of such damages. Further, the entire liability of iROJGAR, and your sole and exclusive remedy, for any claim or cause of action arising here under (whether in contract, tort, or otherwise) shall not exceed the lesser of the registration fees paid or maximum one hundred rupees (INR 100).
(13) DISCLAIMER OF WARRANTIES
iROJGAR disclaims any and all responsibility or liability for the accuracy, content, completeness, legality, reliability, or operability or availability of information or material displayed in iROJGAR results or posted on iROJGAR web portal by iROJGAR or third parties. iROJGAR disclaims any responsibility for the deletion, failure to store, miss delivery, or untimely delivery of any information or material. iROJGAR disclaims any responsibility for any harm resulting from downloading or accessing any information or material available on iROJGAR’s portal or via other portal on the Internet accessed through iROJGAR. You understand and agree that you download or otherwise obtain material or data through the use of iROJGAR services or portal at your own discretion and risk and that you will be solely responsible for any damages to your computer system or loss of data that results from the download of such material or data. Only the courts of SURAT city, Gujarat, India shall have the jurisdiction for any legal dispute.
(14) GENERAL INSTRUCTIONS
Be sure to refer to the TOU regularly, since they change, and they do govern your relationship with iROJGAR. The TOU constitute the entire understanding of arrangement between you and iROJGAR and control procedure for your use of the service. The TOU and the relationship between you and iROJGAR shall be governed by the laws of the country of India without regard to its conflict of law provisions. The failure of iROJGAR to exercise or enforce any right or provision of the TOU shall not constitute a waiver of such right or provision. If any provision of the TOU is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOU remain in full force and effect.
